Supreme Court responsible for inciting religious war, uproar over Nishikant Dubey’s statement, BJP distanced itself

  • April 20, 2025

BJP MP Nishikant Dubey has given such a statement about the Supreme Court which has created a political storm. Nishikant Dubey said that the Chief Justice of the Supreme Court is responsible for all the civil wars taking place in the country. Also alleged that the Supreme Court is responsible for inciting religious war in the country. However, BJP has distanced itself from Nishikant Dubey’s statement.

In fact, 4-time MP from Godda, Jharkhand, Nishikant Dubey said that the Supreme Court is going beyond its limits, he said that the court is repealing the laws passed by the Parliament and even giving instructions to the President, who appoints the judges of the Supreme Court. He said that it is the job of the Parliament to make laws under Article 368 of the Constitution and the role of the court is to interpret the law. He said that if we have to go to the Supreme Court for every work, then should the Parliament be closed? The BJP MP further said that laws have been made for everything, then from where and how is the Supreme Court making new laws.

BJP MP Nishikant Dubey asked how can you give instructions to the appointing authority? The President appoints the Chief Justice of India, the Parliament makes the law of this country. Will you give instructions to that Parliament?

BJP distances itself from Nishikant Dubey’s statement
At the same time, distancing itself from Nishikant Dubey’s statement, BJP National President JP Nadda said in a post on X that the Bharatiya Janata Party has nothing to do with the statements made by BJP MPs Nishikant Dubey and Dinesh Sharma on the judiciary and the Chief Justice of the country. This is their personal statement. The BJP neither agrees with such statements nor has it ever supported such statements. The BJP rejects these statements outright. The Bharatiya Janata Party has always respected the judiciary, has gladly accepted their orders and suggestions. Because as a party, we believe that all the courts of the country including the Supreme Court are an integral part of our democracy. Also, they are the strong pillars of the protection of the Constitution. Nadda said that I have instructed both of them and everyone else not to make such statements.

    Uproar over BJP MP’s statement
Nishikant’s remarks came amid the ongoing hearing in the Supreme Court on the recently passed Waqf (Amendment) Act, 2025. During the hearing, the court had raised questions on some provisions of the Act, including the ‘Waqf by User’ provision. Then the government had assured the apex court that it would not implement some parts of the Waqf (Amendment) Act till the next hearing on May 5. But now politics has heated up over Nishikant Dubey’s statement. While the Congress termed it a blow to the judiciary, Congress leader Salman Khurshid said that anyone who understands the legal system even a little bit will never make such a comment on the judiciary.
The final decision in the judicial system is not of the government: Salman Khurshid

On the statement given by BJP MP Nishikant Dubey on the Supreme Court, Congress leader Salman Khurshid said that if any MP questions the Supreme Court or any court, it is very sad. In our judicial system, the final decision is not of the government, but of the Supreme Court, if someone does not understand this, then it is very sad.

    AAP took aim

At the same time, Aam Aadmi Party spokesperson Priyanka Kakkar said that Nishikant Dubey has given a very bad statement. I hope that tomorrow itself the Supreme Court will take suo motu cognizance against BJP MP Nishikant Dubey and initiate contempt proceedings and send him to jail. Whenever a judge gives a decision in favor of the BJP, he is sent to the Rajya Sabha and now when a judge directed that the law should be followed and governors should not sit on bills indefinitely, the BJP has put all its resources to defame the judges and attack the Supreme Court.

‘Nishikant trying to weaken the Supreme Court’
On Nishikant Dubey’s statement on the Supreme Court, Congress MP Jairam Ramesh said that he is trying to weaken the Supreme Court. Constitutional officials, ministers, BJP MPs are speaking against the Supreme Court because the Supreme Court is saying one thing that when a law is made, you should not go against the basic structure of the Constitution and if the law is against the Constitution, we will not accept it. Deliberately, the Supreme Court is being targeted because on many issues like electoral bonds, the Supreme Court has said that what has been done by the government is unconstitutional.
