No relief for Arvind Kejriwal, will have to wait longer in jail, next hearing will be on September 5

New Delhi. Arvind Kejriwal is lodged in Tihar Jail in the Delhi liquor scam case. Arvind Kejriwal’s bail plea was heard in the Supreme Court today i.e. on Friday. Earlier, the CBI filed its counter affidavit in the Supreme Court. The CBI opposed Arvind Kejriwal’s bail in its affidavit and said that the judge should not grant him bail. The Chief Minister of Delhi is the kingpin of the liquor scandal. A bench of Justice Suryakant and Justice Ujjal Bhuiyan heard Arvind Kejriwal’s bail plea in the Supreme Court today.

During the hearing in the Supreme Court, the CBI said that we have filed the reply in one case, we need time for the other. However, Singhvi opposed it. But the Supreme Court did not listen to Singhvi and gave time to the CBI. Now the hearing of this case will be held on September 5.


In fact, before the hearing, the CBI opposed the granting of bail to Arvind Kejriwal in its affidavit. In its reply, the CBI said that Arvind Kejriwal is the kingpin of this scam. Despite not being the minister of the Excise Department, Arvind Kejriwal is the architect of the entire liquor scam. He knew everything about this scam because all the decisions were taken with his consent and direction. Arvind Kejriwal is not giving satisfactory answers to the questions of the investigating agency.

The CBI further said that he is trying to make the matter politically sensational before the court. Let us tell you that the High Court, while rejecting Arvind Kejriwal’s petition, had said that it cannot be said that the arrest of the petitioner was without any proper reason or was illegal. The High Court in its order justified the permission given by the lower court to arrest and send Arvind Kejriwal to custody, for which the procedure was duly followed.

During the hearing, the High Court had said that Arvind Kejriwal’s influence and clout is clear and as the Chief Minister, he not only has influence over the Delhi government but as the supremo and national convener of the Aam Aadmi Party, he is also very influential. Also, he has close ties with officials and bureaucrats. During the custodial interrogation, Arvind Kejriwal was also confronted with sensitive documents and statements of witnesses in the case. As far as the arrest of the petitioner is concerned, there has been no violation of law. Apart from this, the facts and circumstances of each case are different. Arvind Kejriwal’s arrest has been done under the procedure established by law.

The High Court had said that releasing Arvind Kejriwal on bail will have a serious impact on the hearing of the case in the lower court, which is still in the initial stage, while the key witnesses are yet to testify. As far as the claim for interim bail on medical grounds is concerned, treatment can be done in Tihar Jail Hospital or any of its referral hospitals as per the jail rules and manuals in relation to diseases. There is no case for the petitioner to be released on medical bail, which should be granted only when treatment is not possible in jail.

In the last hearing, the Supreme Court had issued a notice to the CBI on August 14 and sought a reply on Arvind Kejriwal’s bail plea. For this reason, the CBI has given its reply today and made several allegations. Arvind Kejriwal has got bail in the ED case related to the Delhi liquor case, he is just waiting for bail in the CBI case.
