    In the midst of Atul Subhash case, SC made an important comment, how much alimony will the husband pay to his wife, gave 8 parameters

    New Delhi. Discussions are going on in the suicide case of software engineer Atul Subhash. Meanwhile, on Tuesday, the Supreme Court has made an important comment in a case related to alimony. The court has presented 8 factors, on the basis of which the alimony to be given to the wife can be decided. However, the court has issued these factors in a different case related to a divorce.

    Justice Vikram Nath and Justice Prasanna B Varale were hearing this case related to divorce. The court said that every aspect of this marriage had completely broken down under the jurisdiction of the Hindu Marriage Act. The court also said that giving permanent alimony to the wife in this case is the only option that needs to be considered.


    What formula did the Supreme Court give?
    The apex court has presented 8 factors, on the basis of which alimony can be decided. However, the court has also clarified that these are not clear formulas for deciding the amount, but can be used as guidelines for deciding on permanent alimony.

    1- Economic and social status of both the parties
    2- Reasonable needs of wife and dependent children
    3- Education and employment status of the parties involved
    4- Applicant’s assets and independent sources of income
    5- Comforts and amenities available to the wife while living in her in-laws’ house
    6- If some employment-related sacrifices have been made for the responsibilities of the family
    7- If the wife is not working, then the expenses incurred on the case
    8- Financial capacity of the husband, his income, liabilities

    Atul Subhash case
    Atul Subhash has made serious allegations against his wife Nikita Singhania, mother-in-law Nisha Singhania, uncle Sushil Singhania and wife’s brother Anurag Singhania by releasing a video of about one and a half hours and in a 24-page suicide note. Along with this, he has also included the name of Principal Judge Rita Kaushik in Jaunpur Family Court in the note. However, on Wednesday, an FIR has been lodged against four people including Nikita based on the complaint of Subhash’s brother Vikas Kumar.

    Subhash’s uncle Pawan Kumar alleged that his nephew was being harassed and tortured for money and his wife and the judge also insulted him.

    He said, “Whatever happened is very unfortunate. He was losing the case (filed by his wife). He was being harassed. They (wife and in-laws) were constantly asking him for money. According to his status, he was giving her (wife) money for the maintenance of the child.”

    Initially, the family demanded Rs 40,000 per month, later doubled it and then asked Subhash to pay Rs 1 lakh. Kumar alleged that Subhash’s wife and her in-laws were extorting money from his nephew on the pretext of maintenance of the child (Subhash’s four-year-old son).
